Terms of Service

1. Agreement to these Terms

These Terms of Service form a binding agreement between you and the operator of Tong (“Tong,” “we,” “us,” or “our”). They govern Tong’s websites, applications, image and video tools, editing and character tools, storage library, wallet, credits, and related services (the “Service”). By creating an account, purchasing or receiving credits, uploading content, requesting a generation, or otherwise using the Service, you agree to these Terms and the policies linked below. If you use Tong for an organization, you represent that you have authority to bind it.

2. Eligibility

You must be at least 18 years old and legally capable of entering this agreement. If local law requires a higher age, that age applies. You may not use the Service where prohibited by law, sanctions, trade controls, or a prior serious enforcement action. You are responsible for confirming that Tong and your intended content use are lawful where you live and distribute content.

3. Accounts and security

Provide accurate information and keep it current. You may use email and password or an approved identity provider such as Google. Keep credentials confidential, do not sell or share accounts, and notify support@tong.ai promptly if you suspect compromise. You are responsible for account activity except to the extent caused by Tong’s breach of a legal duty. We may impose reasonable upload, storage, generation, payment, concurrency, and wallet limits to protect the Service.

4. The Service

Tong lets users generate, edit, animate, organize, and store images and videos using prompts, references, settings, and workflows. Features, models, providers, formats, quality, processing time, and availability may change. Third-party model, storage, identity, and payment providers may reject, delay, or discontinue processing under their own policies.

Tong is a creative tool, not legal, medical, financial, safety, engineering, or professional advice. Independently review every output before relying on it, publishing it, or using it commercially.

5. Your Inputs

Inputs include prompts, images, video, audio, character references, annotations, names, metadata, and other material you submit. You retain rights you already have in Inputs. You grant Tong a limited, worldwide, non-exclusive license to host, copy, transmit, transform, and process Inputs only as reasonably necessary to operate, secure, support, and improve the Service, enforce policies, and comply with law.

• You own the Inputs or hold every required license, permission, and consent.
• Your processing request does not violate law, contract, privacy, publicity, intellectual-property, confidentiality, or data-protection rights.
• Every identifiable person has provided the consent required for the processing and intended use, especially for intimate, sensitive, biometric, or commercially exploited material.
• Inputs do not contain malicious code or attempts to compromise the Service.

6. Outputs and your responsibility

Outputs are images, videos, metadata, suggestions, or other material returned by the Service. As between you and Tong, and to the extent permitted by law and provider terms, Tong does not claim ownership of your Outputs. Copyright or other exclusive rights may not arise in AI-generated material, and similar outputs may be generated for other users.

You are responsible for every generation you request and every way you use, edit, publish, distribute, sell, license, display, or rely on an Output. Before use, review it for legality, accuracy, safety, misleading implications, third-party rights, required permissions, and audience suitability. Tong does not guarantee that Outputs are unique, accurate, non-infringing, lawful, unbiased, defect-free, or suitable for commercial use. Add synthetic-media disclosures where law or context requires them.

7. Real people, identity, and consent

Do not use Tong to impersonate, harass, exploit, defame, deceive about, or violate another person. Obtain valid permission before using another person’s face, body, voice, name, identity, private information, or recognizable characteristics where permission is required. Do not create deceptive media that falsely presents a real person as participating in political, sexual, criminal, medical, financial, employment, endorsement, or other high-impact activity. A reference-image feature does not mean Tong verified your rights; you must maintain evidence of permission.

8. Prohibited use

You must not upload, request, create, store, or distribute content or activity that creates credible legal, safety, security, rights, payment, or operational risk.

• Any sexual exploitation or sexualization of a minor, or attempts to portray a minor as an adult for sexual content.
• Non-consensual intimate imagery, sexualized deepfakes, voyeurism, trafficking, coercion, blackmail, grooming, or exploitation.
• Fraud, harmful impersonation, forged identity documents, false evidence, deceptive financial records, or manipulation of high-impact decisions.
• Illegal, defamatory, harassing, hateful, violently extremist, or rights-infringing content.
• Malware, credential theft, unauthorized access, evasion of safety or payment controls, scraping, resale, or attempts to expose credentials, private data, or system prompts.

9. Characters and reusable references

Character profiles can contain sensitive likeness and body information. Create and use them only for synthetic characters or people you are authorized to represent. Do not use profiles to evade consent, intimate-image, impersonation, or deceptive-media restrictions. Deleting a character profile may not delete independently stored source assets or outputs; remove those separately when you no longer have a lawful basis to keep them.

10. Credits and wallet

Tong credits are closed-loop units usable only for eligible Service features. They are not money, stored value, a bank deposit, an investment, a cryptoasset, or transferable property. Your wallet may show paid, promotional, reserved, and available credits. Available credits equal paid plus promotional credits minus active reservations.

The exact workflow price is shown before submission. Tong reserves that amount when a request begins, spends the applicable amount after success, and releases unused reservations after covered failure or cancellation. Multi-scene requests may charge completed scenes and release failed scenes. Promotional credits are consumed before paid credits and ordinarily have no cash or refund value. Future prices and the credit-per-dollar conversion rate may change, but a valid server-issued quote is not changed retroactively.

11. Purchasing credits

Checkout displays the amount payable, currency, credits, and applicable conversion rate. Card payments may be processed by Whop and crypto payments by NOWPayments. Provider terms, identity checks, networks, exchange rates, fees, and privacy practices may apply. Tong does not store full card details when checkout is provider-hosted.

A redirect is not proof of payment. Credits are issued only after Tong verifies a successful provider event or reconciliation. Use only authorized payment methods. For crypto, send the exact supported asset on the stated network to the stated address before invoice expiry; unsupported or incorrect transfers may be delayed or unrecoverable.

12. Refunds, reversals, and disputes

Refund eligibility follows the Refund Policy and mandatory law. Successfully consumed credits and completed generation charges are not refundable solely because an output did not match subjective expectations. If a payment is refunded, reversed, disputed, or invalid, Tong may remove associated unspent credits, restrict the wallet, suspend new generations, or request repayment. Crypto transfers generally cannot be reversed at network level.

13. Storage and availability

Tong’s library is not an archival backup. Keep independent copies of material you need. Deletion may be permanent, while non-media transaction, safety, or audit records may remain for fraud prevention, disputes, legal compliance, and security. Maintenance, provider failures, network conditions, demand, abuse controls, or events outside reasonable control may delay or interrupt service.

14. Tong intellectual property

Tong and its licensors retain rights in the Service, software, interface, design, branding, documentation, workflow logic, and non-user content. These Terms grant a limited, revocable, non-exclusive, non-transferable right to use the Service. Do not copy, sell, lease, reverse engineer, or extract source code except where law or an applicable open-source license permits it. “Tong” and its logo are protected marks.

15. Rights complaints and enforcement

Send copyright, privacy, publicity, or other rights complaints to rights@tong.ai with identification of the protected work or person, challenged material and location, contact information, a good-faith statement, and evidence of authority. Tong may restrict material, preserve evidence, notify users, and terminate repeat infringers. We may investigate violations and use proportionate measures including warnings, generation blocking, content removal, account limits, suspension, or termination.

16. Suspension and termination

You may stop using Tong or request account deletion. We may suspend or terminate access for material or repeated violations, legal or safety risk, failed payment, provider abuse, or where continued service is unlawful or impracticable. When reasonable and lawful we will provide notice and an appeal route. Provisions concerning payment, content responsibility, disclaimers, liability, indemnity, disputes, and records survive termination.

17. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Tong disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, output accuracy or uniqueness, compatibility with every device, or recovery of lost content. Mandatory consumer protections continue to apply where they cannot be waived.

18. Limitation of liability

To the maximum extent permitted by law, Tong and its affiliates, personnel, licensors, and providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, opportunity, data, or content. Aggregate liability for claims relating to the Service will not exceed the greater of US$100 or the amount you paid Tong in the six months before the event giving rise to the claim. These limits do not apply where prohibited by law.

19. Indemnity

To the extent permitted by law, you will defend and indemnify Tong and its affiliates, personnel, and agents from third-party claims, losses, liabilities, costs, and reasonable legal fees arising from your Inputs, Outputs, publication or use of content, breach of these Terms, violation of law, or infringement of another person’s rights, except to the extent caused by Tong’s breach, negligence, or willful misconduct.

20. Changes and general terms

We may update the Service and these Terms. Material changes will receive reasonable notice unless immediate action is required for security, law, provider requirements, or abuse prevention. Continuing after the effective date constitutes acceptance where lawful. These Terms and incorporated policies are the entire agreement about the Service. If one provision is unenforceable, the remainder continues. Failure to enforce is not a waiver. Contact legal@tong.ai for legal notices and support@tong.ai for support.
